1. Definitions
- LSA Escale: SaaS platform available at https://lsaescale.com for managing Google Local Services Ads leads.
- User: individual or legal entity who signs up and uses the platform.
- Account: personal and non-transferable record created by the User.
- Plan: package of features and limits contracted by the User.
2. Purpose
These Terms govern the use of the LSA Escale platform, which lets Users connect Google Ads accounts, view Google Local Services leads, submit lead feedback, generate reports, and automate related workflows.
3. Registration and User responsibilities
- The User declares that the information provided at sign-up is accurate and complete.
- The User is responsible for keeping their password confidential and observing the contracted Plan limits.
- The User is solely responsible for actions performed via their Account.
- The User declares that they hold the necessary authorizations to connect Google Ads accounts to the platform.
4. Plans, billing and cancellation
- Plan prices and limits are described at /pricing and may be updated with reasonable advance notice.
- Payments are processed via Stripe. Recurring charges follow the contracted cycle (monthly or annual).
- The User may cancel the subscription at any time via the billing portal. Cancellation stops future renewals; amounts already paid are non-refundable, except as otherwise required by law (e.g. Brazilian Consumer Code art. 49 — 7-day right of withdrawal for initial purchases).
5. Acceptable use
The User agrees not to:
- Use the platform for unlawful, fraudulent, or third-party-infringing purposes
- Reverse engineer, decompile, or attempt to access the source code
- Overload, interfere with, or attempt to circumvent security mechanisms
- Collect data about other Users without authorization
- Share credentials or grant access to third parties
6. Processing third-party data via the public form
The platform offers a public form at /f/:token to collect data from third parties (prospects). In this case:
- The User acts as Data Controller of the personal data collected (Art. 5, VI LGPD), responsible for purposes and lawful bases.
- LSA Escale acts as Data Processor (Art. 5, VII LGPD), processing data solely as instructed by the User and per these Terms.
- The User commits to processing third-party data in compliance with LGPD, maintaining legitimate purposes, valid lawful bases, and honoring data subject rights.
- LSA Escale may assist the User in handling data subject requests, but primary responsibility lies with the User.
7. Intellectual property
All rights over the platform, brand, source code, layout, content, and materials belong to LSA Escale. The User receives only a non-exclusive, non-transferable, revocable license for personal use during the contract term.
8. Service availability
We strive for the highest possible uptime, but interruptions may occur for maintenance, updates, or events beyond our control. We do not guarantee uninterrupted or error-free availability.
9. Limitation of liability
- LSA Escale is not liable for business decisions made based on information shown by the platform.
- LSA Escale's total liability, in any case, is limited to the amount actually paid by the User in the 12 (twelve) months preceding the event giving rise to the damage.
- LSA Escale is not liable for indirect damages, lost profits, or lost opportunities.
10. Suspension and termination
We may suspend or terminate Accounts that violate these Terms, with prior notice when possible. The User may terminate the Account at any time via Support.
11. Changes to these Terms
These Terms may be updated. Each new version will preserve previous versions by the identifier at the top. Material changes will require renewed acceptance at the next sign-in.
12. Governing law and jurisdiction
These Terms are governed by Brazilian law. The courts of the São Paulo/SP district are elected to resolve any disputes, waiving any other, however privileged.
13. Electronic acceptance
Acceptance of these Terms occurs electronically (checkbox at sign-up or on the re-acceptance screen). Such acceptance is binding and is, for all legal purposes, equivalent to a handwritten signature; it is recorded in consent_logs with date, IP, and version of the accepted texts.
